Eligibility Criteria for Design Protection
- Novelty and Originality: The design must be new or original and must not have been disclosed to the public anywhere in India or abroad prior to filing.
- Distinguishable: Must be significantly distinguishable from known designs or combinations of known designs.
- Applied to an Article: The design must be applied to an article by an industrial process.
- Aesthetic Focus: Must appeal to and be judged solely by the eye. It must not cover purely mechanical or functional utility.
